Checkmate Terms and Conditions

Checkmate is a business in the Consulting Services industry that markets the Checkmate Problem-Solving Web-App.

The use of this web site and problem-solving web app is subject to the terms and conditions set out below. By using this site, the user agrees and is deemed to have agreed to observe all terms & conditions of use, including any privacy or other policies which may appear elsewhere on this web site.

Delivery policy

Subject to availability of services and receipt of payment, transactions are processed immediately and receipt confirmed by way of email.

Return and Refunds policy

We are so confident in our product that we offer a 100% money-back guarantee for our per-use customers.

Option 1: If you have followed the problem-solving process for a particular issue, and after following the steps recommended in the template and checklist, you have had a CCMA award ruled against you for that issue, simply email a scan of the CCMA award, together with your Checkmate transaction number and account details, to info@checkmate.co.za, and we will refund you 100% of the Checkmate transaction fee.

Option 2 (last resort): If you do not conform to the conditions in Option 1, but still believe that you are entitled to a refund because the advice received was not of value to you, email us at info@checkmate.co.za with a brief explanation of the situation you’re experiencing with the employee, as well as the advice that was provided by Checkmate, and we will review your transaction for a refund. Requesting a refund based on option 2 is subject to our discretion, and not guaranteed.

Please note, the guarantee only covers the cost of that Checkmate transaction (R99), and does not cover you for any other costs (employee compensation etc.)

Customer privacy policy

Checkmate shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment options accepted

Payment may be made using Credit or Debit cards that are backed by MasterCard or Visa.

Credit card acquiring and security

Credit card transactions will be acquired for Checkmate via PayFast, who are the approved payment gateway.  PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.  Users may go to www.payfast.co.za to view their security certificate and security policy.  Customer details will be stored by Checkmate separately from card details which are entered by the client on PayFast’s secure site.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.  Transaction Currency is South African Rand (ZAR).

Responsibility

Checkmate takes responsibility for all aspects relating to the transaction including sale of services sold on this website, customer service and support, and delivery of services.

Whilst Checkmate has attempted to ensure that all the information and advice it supplies is accurate, the web site owner makes no representations or warranties, express or implied, including but not limited to warranties as to the correctness or suitability of either the web site or the information and advice contained in it.

Checkmate in particular, draws attention to the fact that the user is responsible for providing to correct information during the problem-solving process. Checkmate will thus, in no way, be held responsible for the provision of incorrect advice.

Subject to Chapter 7 of the ECT Act, the web site owner, its officers, employees, suppliers, ISPs, partners, affiliates and agents, shall not be liable for any damage, loss or liability, howsoever arising, incurred by users or any other persons and resulting from the use or inability to use this web site and its content.

Subject to Chapter 7 of the ECT Act and to the fullest extent possible under the applicable law, the web site owner disclaims all responsibility or liability for any damages, including but not limited to direct, economic, consequential loss or loss of profits, resulting from the use of this site or any of the content and advice provided by this site, in any manner.

Users agree to indemnify and hold harmless the web site owner, its officers, employees, ISPs, servants, subcontractors, partners, subsidiaries and affiliates from any demand, action or application or other proceedings, including for attorney’s fees and related costs such as tracing fees, made by any third party and arising out of or in connection with the user’s use of this web site any of the services offered in any way, including but not limited to the provision of content and advice.

While we take all reasonable security precautions, no liability will lie for damage caused by the malicious use of this site or by destructive data or code that is passed on to the user through the use of this site.

b. Delivering or attempting to deliver any unauthorised or malicious code or content to this web site; and/or

We will pursue prosecution of and compensation from any person that delivers or attempts to deliver any destructive code to this web site or attempts to gain unauthorized access to any page on or part of this web site.

In the event of any part of these Terms and Conditions being found to be partially or fully unenforceable, for whatever reason, this shall not effect the application or enforceability of the remainder of this Agreement.

Failure to enforce any provision of these Terms and Conditions shall not be deemed a waiver of such provision nor of the right to enforce such provision.
